Terms of Service

1. Overview

Vasowin is a digital wellness app designed to help users manage specific phobias — particularly blood, injection, and injury (BII) phobias and vasovagal-syncope-related anxiety — through guided exposure exercises, educational content, and applied-tension techniques.

Vasowin is not a substitute for professional medical or psychological treatment. It is a self-guided tool intended for general well-being and personal practice. If you experience clinical-level distress or medical symptoms, please seek professional care.

2. Eligibility

You must be at least 16 years old to use Vasowin. If your country requires a higher age for digital consent or to enter contracts, that higher age applies. By using the Service, you confirm you meet this requirement.

3. Accounts and Security

To use Vasowin fully, you may need to create an account using your email address. You are responsible for keeping your login credentials confidential and for all activity under your account.

4. Personal Data and Privacy

Your privacy is governed by our Privacy Policy, which forms part of these Terms. By using Vasowin, you agree to the collection and processing of your data as described there.

5. Your Responsibilities

When using Vasowin, you agree to:

• Use the Service only for personal, non-commercial purposes.
• Provide accurate and truthful information.
• Not misuse the Service (e.g., hacking, scraping, reverse-engineering, sharing harmful content, or violating applicable laws).
• Not share your account with others.

We reserve the right to suspend or terminate your account if you violate these Terms.

6. Health and Safety Disclaimer

Vasowin is not medical advice. The Service provides educational and self-guided exposure exercises for gradual desensitization to phobia triggers. We make no guarantees about treatment outcomes or effectiveness.

Important safety guidance

Exposure exercises can provoke real physical reactions including dizziness, nausea, sweating, and fainting (vasovagal syncope). To reduce the risk of injury:

• Always use Vasowin from a safe seated or reclined position (e.g., on a couch, bed, or armchair).
• Never use Vasowin while standing, driving, operating machinery, on stairs, near a sharp object, or in any location where a fall could cause injury.
• If you have a history of fainting, stop the session at the first warning sign (lightheadedness, tunnel vision, ringing in the ears) and lie down with your legs raised.
• If you experience severe or persistent symptoms, stop using the Service and seek professional medical care.

By using Vasowin, you accept full responsibility for choosing a safe setting and physical position. We are not liable for injuries that result from using the Service in unsafe conditions.

7. Subscriptions and Billing

Vasowin offers an optional premium subscription via Google Play.

• Auto-renewal: subscriptions renew automatically at the end of each billing cycle (monthly or annual) unless you cancel at least 24 hours before the renewal date. Renewal pricing is shown in Google Play at the time of purchase and may change subject to Google's policies and applicable law.
• How to cancel: open the Google Play Store → tap your profile → Payments & subscriptions → Subscriptions → Vasowin → Cancel subscription. Deleting your Vasowin account does not cancel a Google Play subscription — cancel it through Google Play separately.
• Refunds: refund requests are handled by Google Play in accordance with their refund policy. We do not process refunds directly.
• Free trials: if we offer a free trial, you will be charged at the end of the trial unless you cancel before it ends. Trial eligibility may be limited to first-time subscribers.
• Price changes: if we change subscription pricing, you will be notified in advance and given the opportunity to accept or cancel before the change takes effect.

Your statutory consumer rights (for example, under the UK Consumer Rights Act 2015 or EU consumer-protection laws) are not affected by these Terms.

8. Intellectual Property

All content on Vasowin — including text, graphics, videos, software, audio, and logos — is owned by or licensed to Vasowin and protected by intellectual-property laws.

You may not copy, modify, distribute, publicly perform, or reuse our materials without our prior written permission. The license we grant you to use the Service is limited, personal, non-exclusive, non-transferable, and revocable.

9. Feedback

We welcome your feedback and suggestions. By submitting feedback, you grant us a worldwide, royalty-free, irrevocable license to use it to improve Vasowin without obligation or compensation.

10. Service Availability

We strive to provide a stable and reliable experience but cannot guarantee uninterrupted access. We may modify, suspend, or discontinue parts of the Service at any time, with or without notice, and without liability to you.

11. Disclaimer of Warranties

Vasowin is provided "as is" and "as available," without warranties of any kind, whether express or implied (including implied warranties of merchantability, fitness for a particular purpose, and non-infringement) except where such warranties cannot be excluded under applicable law.

We do not warrant that the Service will be error-free, secure, or meet your specific expectations. You use Vasowin at your own risk.

12. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Florent Pépin or any team member or contractor be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with your use of the Service. This includes, but is not limited to, emotional distress, data loss, or interruptions in access.

Our aggregate liability for any direct damages, regardless of the cause of action, shall not exceed the greater of (a) £50 GBP or (b) the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law (including your statutory consumer rights).

13. Indemnification

You agree to indemnify and hold harmless Florent Pépin, Vasowin, and their respective contractors from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of (a) your violation of these Terms, (b) your misuse of the Service, or (c) your violation of applicable law or third-party rights.

14. Termination

You may stop using Vasowin at any time, and you may delete your account from inside the app (Settings → Delete Account) or by emailing flox.studio@proton.me.

We may suspend or terminate your account if we reasonably believe you have violated these Terms, for security or fraud-prevention reasons, or to comply with legal obligations.

On termination, all licenses granted to you cease and any sections of these Terms that by their nature should survive (e.g., intellectual property, disclaimers, limitations of liability, indemnification, governing law) will survive.

15. Account Deletion

You can request permanent deletion of your account from inside the app (Settings → Delete Account) or by emailing flox.studio@proton.me with the subject "Delete my Vasowin account". Deletion is processed within 30 days, as described in our Privacy Policy.

Deleting your Vasowin account does not cancel an active Google Play subscription — cancel that separately in your Google Play account settings before requesting deletion.

16. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, government actions, pandemics, labor disputes, power or internet outages, or failures of third-party services on which Vasowin depends.

17. Severability

If any provision of these Terms is held unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

18. Assignment

You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms (for example, in connection with a sale of the business) by providing notice to you.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.

20. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, without regard to its conflict-of-law principles. You and we agree to submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes, except that if you are a consumer resident in another country, you may also bring proceedings in your country of residence and benefit from any mandatory protections of your local consumer laws.

21. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version and bump the "Last updated" date. For significant changes, we will notify users by email or in-app. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
